What Threatens Foreigners Making Regular Border Crossings To Russia?
Some foreigners in Russia have adopted a system that circumvents current migration regulations.
First, the foreigner arrives on a standard business or tourist visa allowing stays of every 90 out of 180 days. The foreigner then leaves after 90 days, but re-enters Russia immediately afterwards, gaining a new migration card.
Some foreigners are sure that this procedure is legal because, especially if they use overland exit points where the migration system is not yet computerized, often nothing is said by the border guards. A new migration card is issued and even new registration is often obtained.
However, the foreigner is in violation of Federal Law No. 115 FZ, Article 5, which clearly states that a foreign citizen who came to Russia on such a visa and stayed for 3 months must exit and stay outside the country for at least 3 months before returning.
If the gap between departure and the new entry is less than 3 months - the foreigner is residing in Russia illegally.
The foreigner faces a ban on entry to the Russian Federation for this:
Foreigners who wish to reside in Russia long-term must have a labor patent, a temporary resident permit or permeant residence permit.
