FAS Ends Practice of Pre-Judicial Dispute Settlement
01.06.07 As of May 13th, The Federal Antimonopoly Service (FAS) may now fine companies 1-15% of proceeds from sales of goods when market infraction has been accomplished, either by the abuse of positions of leadership, or by cartel arrangement. There are now serious fears that new powers may transform the service into one of the most corrupt of departments.
The head of the FAS wishes to prevent this by stopping pre-judicial settlement of disputes. He believes that if infractions are found, it is not necessary to warn the company prior to bringing a case to court. Presently companies are able to make use of the advance notification to eliminate infringements thereby avoiding penal sanctions.
