How To Extend An Employment Contract

11.05.08 To prolong a fixed-term labor contract with an employee it is sufficient for both parties to sign an additional agreement changing the original term of the contract. This is according to Letter # 4413-6 of the Federal Service for Employment and Labor Relations from October 31, 2007.
To bring valid changes to the labor contract, the additional agreement must comply with several conditions. First of all, the agreement must state that the term of the contract is changed, not prolonged. Second, if the term of the contract is changed due to an employee transfer to another position or to another department, this must also be included in the agreement (according to the article 72.2 of the Labor Code of the RF). Finally, conditions for changing the term of an employment contract must be discussed and the agreement signed at least 3 days prior to contract expiration.
