The Government of the Russian Federation has approved the list of groups of goods for which in 2019 mandatory labeling will be introduced (Ordinance No. 792-p, dated April 28, 1998). The same document establishes a timeline for its implementation. Thus, for tobacco products, the labeling will be introduced on March 1, 2019, and for shoe products, on July 1, 2019.
All other groups from this list will be marked from December, 2019. These include:
- linen and textiles for beds, tables, bathrooms, and kitchens;
- leather clothing (including working clothes);
- outerwear for men, women, and children (coats, jackets, raincoats, etc.);
- blouses, blouses, and blousons for women (knitted and knitted);
- cameras, camera flashes, and flash lamps;
- tires and airless tires (pneumatic rubber tires);
- perfume and cologne
Recall that the mandatory labeling of fur products has already been introduced.
This special labeling will be a bar code applied to a fabric or paper label. The bar code can be read by a special device or via a smartphone application. From this, the buyer can receive complete information about the product, namely: country of manufacture, manufacturer, date of manufacture, expiration date, and other information. The state, in turn, will be able to identify counterfeit products via this method.
Organizations which sell goods from the above list without the required marking will face fines of 50,000 to 300,000 rubles and the confiscation of the related goods. Tobacco products sold without proper labeling will incur a minimum fine four times greater: 200,000 rubles.
Starting in 2019, manufacturers, suppliers and other persons involved in the circulation of goods subject to mandatory labeling will be required to transmit information on the turnover of such goods to the operator of a new information monitoring system. How exactly this will be done and who will operate the system, will be established by the Government of the Russian Federation. This is stated in the Federal Law of December 25, 188 No. 488-ФЗ, which amended the Federal Law of December 28, 2009 No. 381-ФЗ “On the basis of state regulation of trading activities in the Russian Federation.” To work with the product labeling systems, participants in trade will need a special electronic signature.
