During a recent inspection, a businessman was not able to provide some documentation because it was in the possession of law enforcement agencies. These documents could have proved that some money in the businessman’s account was not part of his own income. Despite these circumstances, tax collectors assessed additional taxes. The businessman took the matter to court. The Supreme Arbitration Court came to the conclusion that the businessman was fully justified in arguing that producing these documents had been impossible.
