The Supreme Arbitration Court (VAS) of the RF will now allow those companies recording sales of up to 58 million rubles to use the simplified tax system.

The major issue is the deflator index. If indexes are multiplied, the maximum revenue limit for 2009 will indeed amount to 57.9 million rubles.

Tax authorities are against such multiplication.

However, The Presidium of the Supreme Arbitration Court has in a recent verdict announced that the multiplication is necessary. (Resolution of the VAS of the RF # 12010/08 of October 28, 2008). Decisions made by tax authorities and lower courts in favor of Tax Authorities have been overturned by this.

While the case was in process, government authorities reached a decision to increase the maximum revenue to use the simplified tax system to 60 million rubles. Thus, government innovation in reality bears no benefit since according to the existing Tax Code of the RF the amount of revenues is very close to 60 million rubles.
