In a recently case, a taxpayer was charged with additional transport tax. A court ruled that the additional charge was unjustified because the taxpayer mistakenly included an unregistered vehicle, which is not being used on public roads, into the tax declaration. Since the vehicle is not registered and does not run on public roads, no tax should be collected, as the car creates no need for maintenance of the roads, for which transport tax is collected. This is according to Decree of the Federal Arbitration Court of Volga Region from February 21, 2008 for the case # А55-7555/07.
