Recent Changes to Russian Residency Laws Alinga Consulting Group

Permanent residency (Âèä íà æèòåëüñòâî) is issued upon arrival to the Russian Federation to highly-qualified specialists working in the Russian Federation, as well as to their family members (spouses, children under the age of 18, and disabled adult children who are recognized as dependents of their parents) without having to receive temporary residency (ðàçðåøåíèÿ íà âðåìåííîå ïðîæèâàíèå).
Applications for Permanent Residency are issued at the local FMS office serving the foreigner's proposed address for permanent residency. Two copies of the application are issued in a standard form. Residency applications for children that are under 18 or recognized as disabled are to be submitted by the highly-qualified specialist. Information concerning children under 18 can also be entered on one of their parent's applications. Foreigners should submit 4 photographs along with each application, including 4 photographs for each child, and should present the FMS employee the original documents and a copy of each document for:

Proof of identity and citizenship (passport),

The highly-qualified specialist’s work permit,
-
Work agreement or civil-law contract on the fulfillment of work (rendering of services), signed by the highly-qualified specialist and filed in agreement with the laws of the Russian Federation,

Marriage license (for the spouse of the highly-qualified specialist.

For adult children of highly qualified specialists that are incapable of working and registered as dependents of their parents, a birth certificate and proof of inability to work,

For disabled adult children of the highly-qualified specialist, birth certificate, proof of identity and citizenship and proof of disability,

Birth certificate and proof of identity and citizenship for each child named in the application.
A decision on the granting or denial of the residency permit will be made no more than three months after the foreign citizen submits the application.
The residency permit is filed and granted for the duration of the employment contract’s validity, as long as it does not extend past the expiration date of the foreign citizen’s proof of identity.
The duration of the residency permit granted to the highly-qualified specialist and his family members is extended:

If the duration of the contract is extended (in which case the permit will be extended by the duration of the contract);

If the contract is prematurely canceled and the employer or contractor applies for the right to attract a highly-qualified specialist with whom he has signed a new contract residency is extended in fourteen work days from the day the said application for the right to attract foreign labor was submitted;

If the contract is prematurely canceled and the highly-qualified specialist signs a new contract and receives a new work permit – the permit will be extended by the duration of the acting contract.
An extension of residency requires a written request. The extension takes effect on the day that the highly-qualified specialist or a legally competent member of his family aged 18 years or older visits the territorial agency of the Russian FMS where the residency permit was granted, or the agency nearest to where the citizen resides, or, if this is not applicable, where the foreign citizen is residing during the filing of the application, and presents the work agreement and work permit that was granted to the highly-qualified specialist. A photocopy is also acceptable.
The decision to extend the duration of the residency permit is made by the Director of the Territorial Office of the Russian FMS or an individual authorized by him.
