Tax Inspection Denies Companies Registration

 19.10.08 In Moscow businessmen are no longer able to start a new company or re-register already existing one: Tax Inspection #46, the office with jurisdiction over Moscow, is denying registrations en masse for legal entities.
Recently tax authorities incorporated a new internal regulation on verification of a company’s street address. Now, according to our source, property owners must present their future tenants with written confirmation verifying that the new company is actually renting the facility. However, it seems that even with this letter the authorities often deny registration claiming that the address doesn’t exist – the authorities do not send enquiries to property owners before doing so. How does one contest such claim – perhaps by dragging a tax inspector to the address?
Business centers seem to be a common target for this. Addresses where several dozen companies have already registered are by default are considered “bad” – or “mass registration” addresses. Companies with legal addresses that differ from the physical address are also being denied.
Worst of all, entrepreneurs are not able to alter existing documents for previously registered companies. Tax authorities presume that even functioning companies are located at “unacceptable address.”
Stiffening of registration procedures began in the middle of August. By now tax authorities’ actions have crossed over into the irrational. They assume that companies would not want to waste time for court procedures and will not file complaints. A small business owner confided that a company, having filed a claim, did win the case – but only after a year. And court marshals had to force the tax inspection to accept the company’s registration paperwork. It provides sufficient motivation for tax authorities from Inspection #46 with a sarcastic smile to suggest their clients to file a complaint in court. We have no further information regarding complaints files with prosecutor’s office.
