The right to pay VAT in installments is not offered to all taxpayers. A Letter of the Federal Tax Service from October 29, 2008 lists several exceptions. The privilege does not include companies who pay VAT based on Article 174 Paragraph 4 of the Tax Code (TC) of the RF. Among them are companies that issue invoices without paying VAT on the transaction, or issue invoices for transactions exempt from taxes based on Article 194 of the TC. It also includes clients purchasing services from non-resident foreign companies not registered with Russian Federal Tax Service.

Companies importing from Belarus goods manufactured in Belarus also are not allowed to pay VAT in installments.
